TRE-SP Cassa the term of Carla Zambelli and determines ineligibility of 8 years

The São Paulo Regional Electoral Court (TRE-SP) ruled on Thursday, 30, to revoke the mandate of federal deputy Carla Zambelli (PL) and determine his ineligibility for eight years. The decision was 5-2 in the action proposed by Federal Deputy Sâmia Bonfim (PSOL).

The TRE recognized that there was misuse of the media and the practice of abuse of political power in the 2022 elections. Zambelli can still resort to the Superior Electoral Court (TSE).

In a note published after the decision, the parliamentarian stated that “TRE-SP understood to annul the votes of 946,244 citizens of São Paulo and revoke my mandate of federal deputy.”

“This decision has no immediate effects, and I will continue to represent Sao Paulo and my voters until the end of appropriate resources. It is clear that political persecution in our country, against conservatives, is visible as the noon sun. I will continue to fight every day of my life with you, so that we have the hope of a prosperous and worthy Brazil for the Brazilian people, ”said Carla Zambelli.

The case began to be tried in December, when the rapporteur José Antonio Encinas Manfré voted for cassation for ineligibility. In the vote, he emphasized that the parliamentarian published content that sought to discredit the electoral system and disseminate false information, such as untrue news about the alleged manipulation of electronic ballot boxes in Itapeva, in the interior of São Paulo, during the 2022 general elections.

“It is not too much to recognize that the conduct of the represented reached repercussions and severity able to influence the voter’s free and conscious will and to the detriment of the isonomy of the electoral dispute. Therefore, realities justifying the revocation of the Federal Deputy diploma and the declaration of ineligibility, sanctions imposed on it for the practice of abuse of political power and improper use of the media, ”he argued.

Encinas Manfré was accompanied by judges Cotrim Guimarães, Silmar Fernandes and judges Rogério Cury and Judge Claudio Langroiva. They voted against the cassation Maria Claudia Bedotti and Régis de Castilho.

For Bedotti, who opened the divergence, there would be no evidence that the videos published by the deputy and cited in the process were sufficient to compromise the fairness of the elections and equality between the candidates.
