Trump government calls Moraes ‘toxic’ and rebuts Dino’s decision on the STF
Earlier, Minister Flávio Dino determined that Brazilians cannot be affected in the national territory by foreign laws and decisions taken by acts that have been performed in Brazil. He does not quote Moraes or the Magnitsky Law, which was adopted against the minister. But his decision was seen as a message to Americans and an attempt to prevent Washington’s decisions from being applied in Brazil.
Earlier this month, Moraes was the target of the magnitsky law, created in the US to freeze the goods and visas of human rights violators. The Trump government claims that the Brazilian minister should be the target of the sanction for his performance against digital platforms in the US and Jair Bolsonaro. Among the shares is the punishment of any bank that maintains accounts or financial transactions of the minister.
Dino, however, used a request from the Brazilian Mining Institute (IBRAM) against the initiative of Brazilian municipalities to appeal to the courts of other countries. This would be a response to the actions of cities affected by disasters such as Mariana.
In trying to shield Moraes, the STF minister stated that these orders of foreign governments have no effect in Brazil. Except if they are approved by the Supreme. According to him, “foreign laws, administrative acts, executive orders and similar diplomas do not have effects on: a) natural persons by acts in Brazilian territory; b) legal relations celebrated here; c) goods located here, deposited, stored, ed) companies that work here”.
According to Dino’s decision, “foreign judicial decisions can only be executed in Brazil upon proper approval”.
The minister also warns that any violation “is an offense to national sovereignty, public order and morals, therefore the ineffectiveness of such laws, acts and sentences emanating from a foreign country is presumed.
