Unanimously, STF denies Bolsonaro house arrest
Unanimously, the First Panel of the Federal Supreme Court (STF) decided this Thursday (5) to deny a new request for house arrest made by the defense of former president Jair Bolsonaro.
The collegiate validated the individual decision of minister Alexandre de Moraes, rapporteur of the case, who, on Monday (2), kept Bolsonaro arrested in Papudinha, in Brasília.
In addition to the rapporteur, the votes were cast by ministers Flávio Dino, Cristiano Zanin and Cármen Lúcia. The trial was held in a virtual session.
New order
House arrest was requested from the STF by the former president’s lawyers. The defense claimed that the prison facilities are not capable of providing adequate medical treatment to Bolsonaro, who recently underwent surgery for an inguinal hernia and has several comorbidities as a result of the stab wound inflicted on him during the 2018 election campaign.
In the decision, Moares said that Papudinha’s facilities offer adequate medical care. Furthermore, the minister stated that the attempted violation of the electronic ankle monitor, which occurred last year, is also an obstacle to granting the request.
Bolsonaro was sentenced to 27 years and three months in prison in the criminal prosecution of the coup plot. He is serving his sentence in the 19th Military Police Battalion, located within the Papuda Penitentiary Complex, in Brasília.
The place is known as Papudinha and is intended for special prisoners, such as police officers, lawyers and judges.
