USA: Before execution, prisoner swears at prison director and makes obscene gestures
Carey shook and gasped for breath several times before he was pronounced dead. The other two executed in the same way in the state (and the only ones in US history) were Kenneth Smith, 58, in January, and Alan Eugene Miller, 59, in September, who also had the same complications. Kenneth’s execution was the first time, in more than 40 years, that a new method of execution was introduced in the country.
Hours before the execution, the United States Supreme Court rejected the prisoner’s request for a stay of execution. His lawyers argued that the method causes “conscious suffocation” and that the two previous executions with nitrogen did not result in rapid unconsciousness and death, as the state points out. Defenders also argued that the court should review the constitutionality of the execution method.
Governor Kay Ivey said she hopes the victim’s family finds healing after the execution. “(Carey’s crimes) were heinous, unimaginable, without an ounce of regard for human life and inexplicably evil. An execution by nitrogen hypoxia does not compare to the death and mutilation that Vickie experienced,” he added.
The victim’s daughter said that her mother’s future was stolen, but spoke out against Carey’s execution. Jodi Haley, who was 12 years old when the crime happened, said that society failed Carey when he was a child and her family suffered because of it. “The murder of prisoners under the pretext of justice needs to stop. (…) No one should have the right to take away a person’s possibilities, days and life.”
Method was made available in Alabama in 2018
Alabama is the only US state to have used nitrogen hypoxia to carry out a death sentence. The method was made available in the state in 2018.
