Will Bolsonaro be arrested preventively? Moraes can decide this Monday (25)

The expectation in Brasilia is that Minister Alexandre de Moraes of the Supreme Court (STF) decides on the latest precautionary measures imposed on former President Jair Bolsonaro on Monday (25). This means that Moraes can, for example, decide to convert to pre -trial detention to Bolsonaro’s current house arrest.

After receiving Bolsonaro’s defense arguments at the end of Friday (22), Moraes sent the consultation to the Attorney General’s Office, as usual before making a decision.

The reason for a possible arrest would not be the January 8 case that has already been tried at the Supreme Court -starts on September 2 -but for a new investigation for obstruction of justice, which also involves Deputy Eduardo Bolsonaro and now also Pastor Silas Malafaia.

Jurist and professor at the University of São Paulo (USP), Pierpaolo Bottini, who has long experience in STF processes, explains that there are two main concerns in the court. “One is the reiteration of the conduct he understands as criminals, reiteration of threats, interference, attempt to interfere with criminal proceedings. And the other is a concern with an eventual escape from Bolsonaro,” he said in an interview with Infomoney This week.

Regarding the lawsuit against Jair Bolsonaro that will be tried from the 2nd, Bottini believes in a rapid resolution, as it is a lawsuit that has arrested, in this case, former Bolsonaro orders, Mauro Cid.

Regarding the operation involving federal deputy Eduardo Bolsonaro and Pastor Silas Malafaia, launched last week, Bottini believes he is still at an early stage and should take longer to have an outcome. According to the jurist, they have to explain themselves and, only from then, will be known what the evaluation of Minister Alexandre de Moraes about the case.

“But somehow it makes it difficult for Eduardo to return to Brazil, because he will be afraid to receive some precautionary, when he gets here,” he concludes.
