Trump government refuses to inform justice about immigrant deported by mistake

Married to an American citizen, Ábrica García was arrested on March 12 by immigration agents and expelled three days later with more than 200 people to El Salvador.

The Trump administration accuses most of these people to belong to the Venezuelan gang Tren de Aragua, a declared “terrorist” organization by Washington, who did not have evidence.

The government later acknowledged before a court that the expulsion of the Salvadoran was the result of an “administrative error.”

García lived in the United States under legal status protected since 2019, when a judge determined that he should not be deported because he is potentially in danger in El Salvador.

But the administration has stated that it cannot correct the error because Ábrica García is detained in El Salvador. He is accused of being part of the gang MS-13, also declared “terrorist”.

Last week, federal judge Paula Xinis determined that he did not see proof that he is a gang member and asked the government to “facilitate and make” the return of the migrant later until April 7.
