Minister minimizes proposal for Security PEC rapporteur on criminal majority
The Minister of Justice and Public Security, Wellington César Silva e Lima, minimized this Tuesday, 10th, the initiative of the rapporteur of the Proposed Amendment to the Constitution (PEC) of Public Security, deputy Mendonça Filho (União Brasil-PE), to insert into the text a popular consultation on reducing the age of criminal responsibility, a topic historically rejected by PT administrations. Silva e Lima, however, avoided contradicting the rapporteur, with whom he said he had a good dialogue, and refused to openly expose the government’s current position.
“It cannot be said that a form of popular consultation, as an exercise in direct democracy, is in itself an evil. The idea of presenting this debate to Brazilian society is absolutely legitimate, healthy and well oriented from the point of view of those who have this perspective”, stated Silva e Lima, in a meeting to review the actions of bodies linked to the Ministry of Justice and Public Security.

President Luiz Inácio Lula da Silva (PT) did not address the issue of the age of criminal responsibility in his third term and there are no recent statements from his allies, but, historically, the issue is rejected by Lula and segments linked to the PT. In 2007, during his second term, Lula said he was completely against it and stated that crimes committed by young people under 18 are a minority.
Opportunity with security!
In the assessment of the current Minister of Justice, a possible popular consultation would allow “the diverse political forces and perspectives of society” to enrich the debate on “the rightness or otherwise of this measure”. Lima e Silva has focused on creating bridges and supporting Congress in its attempt to approve the Public Security PEC.
The government has not yet taken a position on the report produced by Mendonça Filho. The president of the Chamber, Hugo Motta (Republicanos-PB), stated that he should discuss new debates on the PEC after carnival.
