PT says there is no 'foundation' for discussing ineligibility after parade

With questions from the opposition and threats to request President Luiz Inácio Lula da Silva’s ineligibility after the Acadêmicos de Niterói parade, the PT’s legal department released a statement stating that there is no “legal basis” for any discussion of this nature in relation to the episode.

The note highlights that the “plot presented is a typical manifestation of freedom of artistic and cultural expression, fully guaranteed by the Federal Constitution” and that there was no participation, financing, coordination or any interference by the Workers’ Party or President Lula in the conception or execution of the parade.

“The jurisprudence of the Federal Supreme Court and the Superior Electoral Court is firm in the sense that spontaneous political and cultural demonstrations by artists constitute a legitimate exercise of freedom of expression, including in electoral contexts and at public events”, highlights the text.

Furthermore, the note points out that the mere exaltation of personal qualities of a political agent does not constitute early electoral propaganda and recalls that the TSE has already analyzed the issue by rejecting injunctions, although, it is worth highlighting, the court left room for a possible contrary judgment later.

“The Workers’ Party reaffirms that it operates in strict compliance with electoral legislation, having previously guided its members and supporters regarding the rules applicable to the pre-campaign period”, says the note.

As GLOBO showed, there are disagreements among experts about whether the parade on Sunday night honoring Lula was illegal.

The opposition spent the day promising ineligibility actions at the TSE. After the senator and presidential pre-candidate, Flavio Bolsonaro, from the NOVO party and the opposition leadership in the Chamber, senator Rogério Marinho (PL-RN), who is one of the PL coordinators for the 2026 campaign, reinforced the message of contestation in court.

He said that the parade went beyond the “limits of reasonableness” and that an imbalance had been created in the democratic dispute. “We will not accept the normalization of the indirect use of high-profile cultural events as an instrument of personal and electoral promotion. We will adopt all appropriate legal measures with the provocation of the Electoral Court, so that possible abuse of political power and improper use of structures that should serve all Brazilians can be investigated”, stated Marinho.
