Gilmar files PGR against CPI rapporteur for possible abuse of authority

The minister of the Federal Supreme Court (STF) Gilmar Mendes sent a representation to the Attorney General’s Office (PGR) asking that the body investigate senator Alessandro Vieira (MDB-SE) for possible abuse of authority.

The reason is the parliamentarian’s attempt to indict STF ministers in the final report of the CPI on Organized Crime. For the minister, Vieira’s initiative would have deviated from the purpose of the parliamentary investigation.

If a representation progresses, the STF can judge senator Alessandro Vieira and even make him ineligible in a decision

In the text, Vieira proposed the indictment of Gilmar Mendes, Dias Toffoli and Alexandre de Moraes, in addition to the Attorney General of the Republic, Paulo Gonet, for alleged crimes of responsibility.

The report did not pass: it was overturned by 6 votes to 4. When calling the PGR, Gilmar highlighted that the CPI itself rejected the rapporteur’s proposal.

He also cited the note from the president of the STF, Luiz Edson Fachin, who expressed solidarity with his colleagues and repudiated the report.

In the letter sent to Gonet, Gilmar stated that the rapporteur’s “clear deviation from purpose” “did not even find support among his peers”, who chose to reject the suggested final text.

The minister wants the PGR to assess whether the senator’s conduct constitutes abuse of authority.

The PGR has not yet announced whether it will open an investigation.

If it understands that there is evidence of a crime, the body may ask the STF itself to open an investigation to investigate Alessandro Vieira’s role in the Organized Crime CPI.
