Moraes denies Braga Netto’s request to have cable TV in prison and authorizes visits
Federal Supreme Court (STF) Minister Alexandre de Moraes denied General Walter Braga Netto’s defense request to have access to cable TV in the cell where he is serving his sentence at the Command of the 1st Army Division, in Brasília. The decision is due Tuesday, 10th.
Sentenced to 26 years in prison for participating in the coup d’état plan after the 2022 elections, the former minister of the Civil House of the Jair Bolsonaro (PL) government requested, in addition to authorization for visits and enrollment in higher education, the installation of the subscription television service in the military unit where he is held.

When analyzing the petition, Moraes stated that the Criminal Execution Law guarantees prisoners rights compatible with deprivation of liberty, but highlighted that they are not absolute. “There is no legal provision that guarantees the prisoner the right to possess or install electronic equipment, as in the case of cable TV”, wrote the minister when rejecting the request.

Moraes also ordered lawyers to inform, within five days, which higher education course Braga Netto intends to take in distance learning for possible remission of sentence.
“The prisoner expressed interest in remission of his sentence through study, requesting authorization to enroll in a course to be taken at Faculdade Estácio, in distance learning. However, despite the defense having presented the list of available courses, it failed to indicate which course the prisoner chose among those listed, with the indication of the course being necessary for the analysis of the request”, he said.
According to the Penal Execution Law, a prisoner can redeem one day of his sentence for every 12 hours of study.
In the same decision, the rapporteur authorized visits previously indicated by the defense, all from 2pm to 4pm: on Thursday, 12th, by senator and former vice-president Hamilton Mourão (Republicanos-RS); on Sunday, 15th, by Alexandre Chaves Faria and Ione Souza Braga Chaves Faria; on Tuesday, 17th, by Sergio Borges Medeiros da Silva and Flávio Murillo Barbosa do Nascimento; on Thursday, 19, by Eduardo José Barbosa and João Batista Souza dos Santos; and on Sunday, 22, by Eduardo Scalzilli Pantoja.
Walter Braga Netto was sentenced to 26 years in prison in a closed regime, for the crimes of armed criminal organization, attempted violent abolition of the Democratic Rule of Law, coup d’état, qualified damage through violence and serious threat and deterioration of listed property.
He had already been imprisoned since December 2024, accused of obstructing the investigation into the attempted coup to prevent the inauguration of President Luiz Inácio Lula da Silva (PT).
