Novo sues TSE against Lula and samba school for early election propaganda
The Partido Novo filed a representation at the Superior Electoral Court (TSE), this Tuesday (10), against President Luiz Inácio Lula da Silva (PT), the Workers’ Party and the samba school Acadêmicos de Niterói for early electoral propaganda.
According to the acronym, the school’s samba, “From the top of the mulungu comes hope: Lula, the worker of Brazil”, goes beyond the limit of a tribute in an election year and favors the current president and the PT in this year’s dispute.
The party also maintains that there is explicit propaganda, with the use of typical electoral campaign elements, such as music that resembles a jingle, the use of the ballot box number 13 and references to the 2022 electoral contest.

In the document, Novo requests that the TSE impose a fine of R$9.65 million, an amount equivalent to the estimated cost of the parade that “favors” Lula. The acronym justifies its action by highlighting that the honorary president of Acadêmicos de Niterói is Anderson Pipico (PT-RJ), councilor in Niterói.
The requested amount differs from the ceiling defined by the TSE, which provides for fines of up to R$25,000 in cases of early electoral propaganda. To justify the increase, the party argues that the fine should be equivalent to the estimated cost of the parade, claiming that the amount stipulated by the court is negligible given the projection that the event will give President Lula.
In addition to the fine, the action requests the granting of an injunction to prevent the use of samba-enredo in the official parade, prohibit the use of images and sounds from the event in future elections and determine the removal of all content already published that deals with the topic in an “exaltation” tone.
