PGR rejects request for arrest of Eduardo Bolsonaro made by PT and PSOL deputies

The Attorney General of the Republic, Paulo Gonet, rejected this Tuesday, 14th, the request for preventive detention presented by deputies Lindbergh Farias (PT-RJ) and Talíria Petrone (PSOL-RJ) against also deputy Eduardo Bolsonaro (PL-SP). The request had been made as part of the investigation investigating the role of Eduardo and commentator Paulo Figueiredo in a collaboration with American authorities to pressure the Federal Supreme Court (STF) in the trial of the coup criminal case, in which former president Jair Bolsonaro was convicted.

At the demonstration, Gonet stated that parliamentarians do not have procedural legitimacy to request precautionary measures such as arrest. “Despite the diligence with which parliamentarians act, they are not qualified to do so in any of these positions,” he wrote.

Gonet added, however, that the PGR will be able to assess in the future whether there is a basis for requesting its own precautionary measures, including arrest, “whenever it deems appropriate”. He also denied the request to suspend the payment of subsidies, quotas and parliamentary funds from Eduardo Bolsonaro, arguing that this type of action is up to the Chamber of Deputies itself, which is already analyzing administrative procedures on the subject.

In July, Lindbergh and Talíria had filed a request for preventive detention against Eduardo Bolsonaro with the Supreme Court. At the time, parliamentarians argued that the son of former president Jair Bolsonaro was negotiating with North American authorities to “sabotage the functioning of Brazilian republican institutions”, especially the STF. Lindbergh cited as evidence a series of offices and public demonstrations by Eduardo in the United States, where the deputy is licensed.

The investigation led by Minister Alexandre de Moraes at the STF is investigating whether Eduardo Bolsonaro coordinated, from the United States, an offensive with American politicians and authorities to pressure the Supreme Court and question the legitimacy of Jair Bolsonaro’s conviction. Eduardo and Figueiredo were denounced for committing the crime of coercion during the process of this investigation.
