STF forms majority to maintain Rodrigo Bacellar’s impeachment

The First Panel of the Federal Supreme Court formed a majority, this Friday (17), to maintain the decision of the Superior Electoral Court that determined the revocation of the mandate of the state deputy and former president of the Legislative Assembly of Rio de Janeiro, Rodrigo Bacellar (União).

The trial began this morning, in a virtual plenary session. So far, the case rapporteur, Minister Cristiano Zanin, Alexandre de Moraes and Flávio Dino have voted against the appeal. All that’s missing is Minister Cármen Lúcia’s vote.

Bacellar was revoked by the TSE in March in the same process that led to the ineligibility of the former governor of Rio, Cláudio Castro (PL). Both were dismissed due to the distortion of Ceperj’s allocation, with mass irregular hiring for electoral purposes, which constituted abuse of power.

After the decision, Bacellar’s defense appealed to the Supreme Court and asked for a suspensive effect to be declared on the decision that condemned the former deputy.

In his vote, rapporteur Cristiano Zanin cited procedural reasons for imposing the denial, since there is still an appeal against the decision. “Given the grounds for the appealed decision and the fact that there has been no change in relation to the procedural situation regarding the filing of a possible extraordinary appeal and its admissibility judgment by the TSE, I believe it is the case to maintain the denial of the precautionary measure on its own grounds”, highlights an excerpt from the vote.

Former president remains in prison

Rodrigo Bacellar remains in prison after a new decision by Moraes, who on Friday the 27th determined the new measure as part of another investigation by the Federal Police, which is investigating the leak of confidential information at Alerj related to a case involving state deputy TH Joias.
