STF maintains suspension of law regulating motorcycle taxis in SP

The Federal Supreme Court (STF) decided this Monday (10) to maintain the suspension of the law in the state of São Paulo that regulated the paid transport of passengers through motorcycle taxi applications.

During the virtual trial, the majority of the Court’s ministers validated the individual decision of the rapporteur, Minister Alexandre de Moraes, who suspended the state rule.

The law established that the state’s municipalities have the power to regulate the provision of the service.

In September this year, the minister responded to the request for an injunction made by the National Confederation of Services (CNS). According to the entity, only Congress can legislate on traffic and transport matters.

When analyzing the case, Moraes agreed with the arguments and suspended the São Paulo law.

“I therefore consider applicable to the case the precedents of this Federal Supreme Court that censure local legislation enacted with the aim of regulating urban transport services contrary to, or without the support of, federal legislation”, said the minister.

In the virtual session, the rapporteur’s vote was accompanied by ministers Dias Toffoli, Edson Fachin, Cármen Lúcia, André Mendonça, Flávio Dino and Cristiano Zanin.

Virtual voting will close at 11:59 pm this Monday.
