STF marks for the 23rd approval of the trial minutes that condemned Bolsonaro
The minutes of the trial that resulted in the conviction of former President Jair Bolsonaro and seven other defendants for attempted coup and other crimes will be approved on September 23, during the next session of the First Class of the Supreme Court (STF), the Court’s Secretariat of Communication said.
This is the first formal period of a long legal rite that, in the end, may lead to the beginning of the prison sentences by the convicts, including Bolsonaro, who was sentenced to 27 years and 3 months in the initially closed regime.
Following the homologation of the minutes on the 23rd, the ministers who participated in the trial will have up to 60 days to formalize the votes presented.
Only after this formalization will the judgment be published – the final decision of the collegiate trial. From the publication of the judgment, it opens the period of five days for the defenses of the convicts to present embargoes of declaration, the only appropriate appeal to clarify any omissions or contradictions in the decision.
Although these are the regimental deadlines, the Supreme pointed out that the calendar could be anticipated.
In general, embargoes do not have the power to reverse the result of the judgment and are often rejected. They are judged by the first class itself.
Only after the analysis of the embargoes can the court decree the final judgment – the end of the possibility of appeals – and effect the arrest orders of the convicts.
