Sentenced at 27, when can Bolsonaro progress in regime?
The conviction of former President Jair Bolsonaro (PL) to 27 years and three months in prison, defined by the first class of the Supreme Federal Court (STF) on Thursday, will be initially complied with closed, but there is a possibility of progression to the semi-open format after the fulfillment of the judgment. Jurists consulted by GLOBO, however, evaluate that Bolsonaro’s situation has aggravating factors that can delay this progression.
The law of criminal execution states that the passage of the closed regime – in which the convict is fully in prison – to the semi -open, in which there is the possibility of only sleeping in jail, can occur from the compliance with 16% of the penalty.
The same legislation, however, establishes a slower progression of 25% of the sentence if “the crime has been committed with violence to the person or serious threat.”
– I understand that the crimes that led to the conviction of Bolsonaro fit into the hypothesis of progression from 25% of the sentence, and not in the event of 16% – said Daniel Kakionis Viana, professor of criminal law and criminal procedural at Cruzeiro do Sul University.
In this case, therefore, the former president could only pass the semi-open regime from six years and nine months in prison.
