Zambelli’s license ends; Deputy arrested in Italy may lose mandate for absences
The license of federal deputy Carla Zambelli (PL-SP) ends this Thursday (2), after 127 days of removal. Arrested in Italy since July, the parliamentarian had obtained authorization for seven days for health treatment and 120 days for a particular interest, but, with the end of the deadline, will have unjustified absences in the plenary sessions.
The mayor, Hugo Motta (Republicans-PB), authorized the removal in June, with retroactive count on May 29. Now, it is up to the housewood regiment to establish the next steps: the deputy or senator who lacks more than one third of the ordinary sessions loses his mandate, except in justified cases.

Cassation Risk
Zambelli faces another process that can lead to the loss of mandate. In August, she was sentenced to 10 years in prison by the STF for invasion of the CNJ system and ideological falsehood. According to Article 55 of the Constitution, condemned parliamentarians with a final judgment may have the mandate revoked, but the final decision is up to the House.

The case is under analysis by the CCJ (Constitution and Justice Commission), which may recommend the cassation. If you reach the plenary, the votes of 257 deputies (absolute majority) are required to confirm the loss of the mandate.
Alternate can assume
If the cassation or loss of absences is confirmed, the vacancy will be occupied by the alternate, Colonel Tadeu (PL-SP). Former PL leader in the House, he was already affiliated to PSL and União Brasil before migrating to Jair Bolsonaro’s party in 2022.
Zambelli’s case recalls that of Deputy Eduardo Bolsonaro (PL-SP), who also requested a 122-day license and remained in the US after the end in July. Since then, he accumulates unjustified absences in the plenary.
