Minister Alexandre de Moraes, of the Federal Supreme Court (STF), declared null the determination of the Federal Council of Medicine (CFM) to open an investigation that would investigate complaints about the conditions of medical care provided to former president Jair Bolsonaro (PL).

Moraes ordered the Federal Police (PF) to hear the president of the CFM within 10 days.

Earlier, this Wednesday (7), the CFM had requested that the Regional Council of Medicine of the Federal District launch an investigation to investigate complaints related to the lack of guarantee of adequate medical assistance to Bolsonaro.

In a note, the CFM highlighted that the autonomy of the attending physician must be sovereign in determining therapeutic conduct, “not being able to suffer influences of any nature, as they have a presumption of truth”. The excerpt contradicts the latest decisions by Moraes, who had previously denied Bolsonaro’s immediate transfer to a hospital to carry out additional tests after a fall on Tuesday (6).

In a note, the CFM highlighted that the autonomy of the attending physician must be sovereign in defining therapeutic conduct, “not being able to suffer influences of any nature, as they have a presumption of truth”.

The excerpt contrasts with recent decisions by Moraes, who had denied Bolsonaro’s immediate transfer to a hospital to carry out additional tests after a fall on Tuesday (6).

The Council’s statement also highlighted that “public statements of reports on clinical complications” involving Bolsonaro cause “extreme concern to Brazilian society, which motivates the Council’s action in strict compliance with its legal duties”.

Since 2022, the CFM has been chaired by gynecologist and obstetrician José Hiran da Silva Gallo, who declared support for Jair Bolsonaro’s re-election and praised the former president’s conduct during the pandemic.

Also this Wednesday, minister Alexandre de Moraes authorized Bolsonaro’s transfer to DF Star Hospital to carry out neurological examinations.

The decision was taken after the former president suffered a fall in the early hours of Tuesday (6), inside the special room where he is serving his sentence at the Federal Police Superintendency, with an initial diagnosis of mild traumatic brain injury.

In the order, Moraes highlighted that Bolsonaro already has, by previous decision of November 2025, permanent medical care at the place of custody, which allowed for immediate care after the episode.

The Federal Police report indicated that the former president reported falling out of bed while sleeping, dizziness throughout the day and intense hiccups at night.
