End of the 6×1 scale: what changes with the project sent by Lula
The federal government sent to the National Congress, this Tuesday (14), a bill that changes the working day in the country and eliminates the possibility of a 6×1 scale. The text reduces the weekly limit from 44 to 40 hours, without providing for a salary cut, and establishes new rules for organizing time off.
The proposal was sent under constitutional urgency. As a result, the Chamber and Senate have up to 45 days to analyze the project before it becomes part of the legislative agenda.

The project sets the weekly work ceiling at 40 hours and maintains the daily limit of 8 hours. The main change is in the distribution of this load throughout the week: the model no longer allows six consecutive days of work with just one day of rest.
According to the text, workers are now entitled to two consecutive days off each week. The preference is for this rest to coincide with Saturday and Sunday, although the rule allows adjustments depending on economic activity or collective negotiations.
In practice, the change requires companies to reorganize their schedules to guarantee continuous rest periods, especially in sectors that operate on weekends.
Commerce and services
For activities that operate uninterruptedly, such as commerce and services, the project determines the adoption of monthly shift schedules. These scales must ensure that all workers have two consecutive days of rest within the period.
The only exception provided for in the text is for activities with specific dynamics, such as theatrical productions, which may follow their own rules.
Maintenance of special scales
The government maintained the possibility of different working hours, such as the 12×36 scale, as long as they were agreed upon by collective agreement. Even in these cases, the weekly average must respect the limit of 40 hours.
The text also authorizes up to two hours of overtime per day, allowing working hours of up to 10 hours. These additional hours do not automatically generate additional payment, as long as they are compensated with a proportional reduction in the load on other days of the same week.
Rules for travel and breaks
The project includes specific devices for workers on the move. On trips longer than a week, the professional will be entitled to 48 hours of rest for every seven days worked.
This period of time off does not replace the minimum break of 11 hours between shifts. The text determines that daily rest must be respected before the start of weekly days off.
Scope beyond the CLT
The proposal also changes category rules with their own legislation, expanding the scope of the changes. Professionals such as radio broadcasters, aeronauts, athletes, security guards at financial institutions and social mothers are included.
In total, the project modifies around ten laws that deal with specific work regimes, aiming to standardize the logic of weekly working hours and rest.
By sending it urgently, the government seeks to speed up voting on the proposal. The text may still undergo changes during processing, especially at points that impact the organization of work in sectors with continuous operation.
