Moraes rejects reviewing the sentence of Débora do Batom, convicted by 8/1
Minister Alexandre de Moraes, of the Federal Supreme Court (STF), denied this Monday (4) a request for hairdresser Débora Rodrigues dos Santos, known as Débora do Batom, to benefit immediately from the Dosimetry bill (PL).
Last week, Congress overturned President Luiz Inácio Lula da Silva’s veto of the project, which benefits those convicted of the coup acts of January 8, 2023.
STF judges on the 20th whether Bolsonaro could block citizens on official networks
The trial of two lawsuits discussing whether the then president could block citizens from his official networks was scheduled for May 20th.
On Friday (1st), one day after the vote, Débora’s defense asked the Supreme Court to reduce the sentence, even before the PL was enacted.
According to the Constitution, the project must be sent for promulgation by the President of the Republic within 48 hours. If this does not happen, the task will fall to the president of the Senate, Davi Alcolumbre (União Brasil-AP).
Crime
She was sentenced to 14 years in prison for participating in the acts and spray-painting the phrase “Perdeu, mané” on the Justice statue, located in front of the Supreme Court headquarters building, with lipstick.
She is currently serving a sentence at home for having minor children.
According to lawyers, Débora has already served three years in prison and could progress to semi-open prison.
Decision
In the decision, Moraes judged the defense’s request to be prejudiced because the Dosimetry PL has not yet been promulgated by the Presidency of the Republic or by Congress.
“The National Congress, in a session held on 4/30/2026, overturned the veto of the Presidency of the Republic (VET 3/2026), with the exception of impaired provisions, on the so-called Dosimetry PL (PL 2.162/2023), with neither the promulgation nor the publication of the normative diploma having occurred, which, therefore, is not in force”, explained the minister.
Since March last year, Débora has been under house arrest in Paulínia (SP), where she lives.
She is monitored by an electronic ankle monitor and cannot use social media or have contact with other people being investigated. In case of non-compliance, she must return to prison.
