Congress will hold a session on Thursday (12) to vote on the 2025 LDO and extra credits

The National Congress, in a joint session of the Chamber and the Senate, meets on Thursday (12) to vote on the 2025 Budget Guidelines Law (LDO) project (PLN 3/24) and several projects that open extraordinary credits to the 2024 Budget.

In total, there are 25 items on the agenda. The session is scheduled for 10 am.

The preliminary report on the 2025 LDO project has already been approved by the Mixed Budget Committee (CMO). The forecast, now, is to vote on the final report in the collegiate, before the Congress session on Thursday.

The deadline for submitting amendments ended yesterday.

Rules for amendments

The impasse over the new rules for parliamentary amendments and doubts about what can and cannot be done with these indications have delayed the vote on the final text.

In August, Minister Flávio Dino, of the Federal Supreme Court (STF), suspended payment of the amendments. Last week, he authorized the release of resources, but imposed new rules.

Parliamentarians complain that the new rules are different from the law approved by the National Congress and sanctioned by the President of the Republic.

New rules for amendments

On Tuesday (10), the government published an ordinance to try to adapt the standards of the amendments to the STF decision on greater transparency and traceability.

“What I defend and will always defend is that each of the Three Powers of the Republic be restricted to their constitutional attributions. When this becomes unbalanced, this type of problem arises”, said the president of the Chamber of Deputies, Arthur Lira (PP-AL).

Negotiations continue. The 2025 LDO rapporteur, senator Confúcio Moura (MDB-RO)warned of a possible “governance blackout” if the proposal is not voted on. “By not approving the LDO, the government will not have important rules for preparing the Budget. It will be complicated for the beginning of next year”, he said.

“We are waiting, with great expectation and common sense, for the two presidents of the Houses (Arthur Lira, from the Chamber, and Rodrigo Pacheco, from the Senate) really call these deliberations so that we can work.”

Priorities

The 2025 LDO provides a fiscal target of balance between revenues and expenses. The preliminary report presented by Moura prioritizes some actions, such as those related to the prevention of extreme weather events.

Other priorities to be considered deal with actions established by the Multi-Year Plan (PPA) and those that refer to ongoing projects. These suggestions will form the Annex of Goals and Priorities of the LDO. This annex must be included in the draft Annual Budget Law (LOA) of 2025. Anything that is not in the Budget cannot be executed.

What is LDO

The LDO project is proposed by the President of the Republic and approved by the National Congress. The text sets goals and priorities for the federal public administration, including expenses for the following financial year.

The LDO guides the preparation of the LOA, provides rules on possible changes to tax legislation and establishes the application policy of official financial development agencies.

Extra credits

In addition to the 2025 LDO project, deputies and senators must vote on a series of projects that open up extra credits.

The one that releases the most resources is PLN 38/24: R$4.031 billion. The majority – R$4 billion – goes to the National Civil Aviation Fund (Fnac).

PLN 14/24 allocates R$67.3 million to Petrobras Netherlands BV, a Petrobras group company dedicated to the maritime and land exploration of natural gas oil.

What are credits

Special credits are a type of authorization for expenses for which there is no specific allocation in the Budget Law. The money for the new expenses comes from the cancellation of other expenses that are foreseen in the Budget.

Supplementary credits are a type of additional credit intended to reinforce the budget allocation already existing in the Budget.

Both must be authorized by law and opened by decree of the Executive Branch.
