AGU reinforces Dino that it is necessary to release health amendments to meet the minimum
The Attorney General’s Office (AGU) reinforced this Tuesday, 31st, to the Federal Supreme Court (STF) that the release of the commitment of commission amendments to Health is necessary to comply with the minimum spending floor in the area provided for by the Constitution . The demonstration was made after Minister Flávio Dino, from the STF, asked the government to “objectively” prove that R$370 million in resources would be “essential” to reach the minimum.
To this end, the AGU attached to its petition documentation prepared by the Ministry of Health which, in the body’s assessment, demonstrates the need for commitment so that the constitutional provision of R$215.5 billion in health spending is met this year.
“It is worth noting that budget execution is subject to variables that are not fully under the control of the Ministry of Health (…) Therefore, it is not possible to accurately determine the value of the commitments that will still be made in the current financial year. If the commitments of RP 8 commission amendments worth R$ 370 million are maintained, the verification of any excess in relation to compliance with the constitutional minimum will lead to the corresponding cancellation of the commitment of RP 8 of the same magnitude”, says the document.

With this, the AGU reiterated its request for the minister to clarify whether or not the decision given on the 29th guarantees “exceptional continuity” in the execution of commission amendments committed until the 23rd, especially with regard to those aimed at Health.
