First Class of the Supreme Court maintains arrest of Braga Netto for interfering with investigations

The First Class of the Federal Supreme Court (STF) rejected, on Friday (14), the request for habeas corpus of the defense of General Braga Netto (PL) and upheld the custody of the former Jair Bolsonaro (PL) plate in the 2022 elections. The military has been under arrest since December 14, 2022.

The decision was unanimous, with the ministers Flávio Dino, Cristiano Zanin, Cármen Lúcia, Luiz Fux and the rapporteur Alexandre de Moraes following the position of the rapporteur and maintaining the arrest of Braga Netto.

According to Moraes, the maintenance of prison is necessary due to the general’s attempts to “embarrass investigations.” The minister stated that the evidence indicated that, since August 2023, Braga Netto has been acting to interfere with the in progress in the Supreme Court.

“The permanence in freedom of the investigated, according to the elements already shown, is against the guarantee of public order, due to the considerable risk of reiteration of illicit actions,” explained Moraes, emphasizing that there is no guarantee that criminal conduct have ceased.

The rapporteur also pointed out that it is still necessary to identify the other members of the operational nucleus, as described by the Federal Police (PF) in his report. According to him, Braga Netto’s freedom would endanger the conclusion of these investigations.

The general is appointed as one of the leaders of the alleged coup plan and the criminal organization, along with Jair Bolsonaro (PL), and would have been a funder of the group’s operations.

Braga Netto’s role in the coup plan was detailed by the PF after findings and testimonials of the former Bolsonaro orders, Mauro Cid. According to the investigations, the military would have discussed the plan to murder STF Minister Alexandre de Moraes, President Luiz Inacio Lula da Silva (PT) and Vice President Geraldo Alckmin (PSB), in a meeting at the General’s residence on November 12, 2022.

Braga Netto’s arrest was decreed after the PF collects evidence that the general tried to obtain confidential information related to the award -winning collaboration agreement signed by Mauro Cid.

Braga Netto is one of those denounced by the Attorney General’s Office (PGR) for the alleged attempted coup d’état in 2022, aiming to prevent the inauguration of Luiz Inacio Lula da Silva as president-elect.

The analysis of the complaint against Bolsonaro and his allies, which may make them defendants, will be held on March 25 by the same ministers who maintained the arrest of Braga Netto.
