STF will judge on March 25 denunciation of the coup against Bolsonaro and allies

The first class of the Supreme Federal Court (STF) begins on Tuesday (25) the analysis of the complaint of the Attorney General’s Office (PGR) about the alleged coup plot of 2022, which would have been organized to prevent the inauguration of President Luiz Inacio Lula da Silva (PT). The trial may make former President Jair Bolsonaro (PL) and other defendants of the process.

The president of the class, Minister Cristiano Zanin, reserved three sessions for the trial, being on the morning and afternoon of Tuesday, with the possibility of a third session on Wednesday morning (26), if more discussion time is needed. It is expected that the issue will be voted later this week.

  1. Opening of the trial: The trial will be started by the president of the first class, Minister Cristiano Zanin, followed by reading the report of Alexandre de Moraes, who is the rapporteur of the case.
  2. Oral support of the Attorney General: The Attorney General of the Republic, Paulo Gonet, will have 30 minutes to defend the complaint and the validity of the accusations made against those involved in the alleged coup plot.
  3. Defenses of the accused: After the prosecutor’s manifestation, the defenses of the eight reported will have 15 minutes each to speak up. The pronouncement order will be defined by Zanin.
  4. Preliminary questions: Before addressing the merits of the complaint, ministers may vote for preliminary issues that may influence the decision. These questions are specific aspects of the process that need to be resolved before the main analysis.
  5. Vote on the merits of the complaint: After the manifestations and preliminary issues, Alexandre de Moraes will assess the merits of the complaint and decide whether or not to accept it. If you accept, the other ministers will vote for.
  6. Final decision: If the complaint is accepted by majority or unanimity, the accused will become defendants and respond to a further judicial proceedings. The trial may be concluded with the acquittal or conviction of the defendants, with the definition of penalties by the ministers.
