Moraes denies arresting Bolsonaro for protest for the amnesty of the scammers of January 8

Minister Alexandre de Moraes of the Federal Supreme Court (STF) rejected on Wednesday, 2, a request to decree the pre-trial detention of former President Jair Bolsonaro (PL) for calling demonstrations for the amnesty of the 8 January scammers.

The minister welcomed the opinion of the Attorney General’s Office (PGR) against the arrest of the former president. Attorney General Paulo Gonet said he sees no crime in the protests in favor of amnesty, as long as they are “peaceful.”

Bolsonaro participated in an act in Copacabana on March 16 for the amnesty for the convicts of the scammer acts of January 8. A survey of the monitor of the Public Debate of the Digital Environment, from the Brazilian Center for Analysis and Planning (Cebrap) of the University of São Paulo (USP), pointed out that the demonstration brought together 18,300 people. The value represents less than 2% of the public of one million people who were expected for the act.

Gonet also claimed that the assessment of the need for arrest or other precautionary measures against the former president was made by offering the coup plan denunciation and that “there is no new circumstance capable of modifying the understanding previously signed by Parquet.”

There is already a criminal action underway against the former president. Any “new fact” that justifies your prison or other precautionary measure will be evaluated in the process. Bolsonaro’s passport is retained in the investigation.

The criminal news against Bolsonaro-now filed by Moraes-was moved by Recife councilor Liana Cristina (PT). In triggering the Supreme Court, the councilwoman stated that the former president’s goal in summoning the demonstration was the “incitement to new acts that compromise public order and democratic stability.”

Moraes’s decision states that the parliamentarian has no formal legitimacy to request the arrest of the former president and that this attribution is from the Attorney General’s Office.

“Given the above, I welcome the manifestation of the Attorney General’s Office and I do not know of the requests made by illegitimacy of the party, pursuant to the Supreme Court Internal Regulations,” wrote the minister.
