Court grants house arrest to Roberto Jefferson, but he remains in jail

The Federal Regional Court of the 2nd Region (TRF-2) authorized on Wednesday, 2, that former deputy Roberto Jefferson will serve a sentence in house arrest. The conversion of the sentence, however, will not be immediate, as Jefferson has a pre -trial detention in force until defense appeals in the Supreme Federal Court (STF). He faces two different cases in the two courts.
The TRF-2 decision complies with a request from the defense of the former parliamentarian and was based on a report by the Medical Board of the State Secretariat of Penitentiary Administration (Seap), which describes a situation of “extreme weakness”.

In the Supreme Court, Jefferson was considered guilty for inciting people to practice violence against parliamentarians of the Parliamentary Commission of Inquiry (CPI) that investigated acts of the Presidency of the Republic during the Covid-19 pandemic and to explode the building of the Superior Electoral Court (TSE).
He was tried by the Court because, according to the rapporteur, Minister Alexandre de Moraes, the incident is related to the scammer acts of 8 January 2023.
Former President Jair Bolsonaro (PL) supporter was also convicted of slander for accusing then-Senate President Rodrigo Pacheco (PSD-MG) of prevarication; and by homophobia, by saying that members of the LGBTQIA+ community would represent the “moral demolition of the family”. The penalty set was nine years, one month and five days in prison.
Already in the TRF-2, the process of the former PTB deputy concerns the attack on Federal Police agents who were serving an arrest warrant issued by Minister Alexandre de Moraes in October 2022. Jefferson responded to the approach with the launch of a grenade and rifle shots, injuring two police officers.

According to the Court, Roberto Jefferson is forbidden to use social networks or communication applications and leave Rio de Janeiro, except in a medical emergency that must be proven and communicated to the Federal Court. He had revoked his possession and firearm registration documents.
