The president of the Federal Supreme Court (STF), Minister Edson Fachin, is expected to receive parliamentarians in the coming days to discuss the so-called Dosimetry Law, approved by Congress after the veto of President Luiz Inácio Lula da Silva (PT) was overturned. Among members of the Court, the assessment is that Fachin is closely following the political reaction to Alexandre de Moraes’ decision to suspend the rule.

THE Globe found that Fachin told people close to him that he was awaiting the release of the case for discussion by Moraes before determining the inclusion of the actions on the agenda, respecting the regular procedure within the STF. The president, however, signaled that, once the process is released, it should not take long to include the trial on the agenda.

Members of the STF also state that parliamentarians have sought out the president of the Court in recent days to discuss the Dosimetry Law and that he should receive them in private hearings throughout the week.

A STF minister stated that Moraes’ decision to temporarily suspend the application of the new law in criminal executions on January 8th follows a common procedural logic given the judicialization of the issue.

According to this judge, as direct actions of unconstitutionality have already been presented to the Court, the rapporteur opened a deadline to hear those involved and chose to maintain, for now, the current scenario in executions, avoiding successive changes of understanding before the plenary analysis.

The actions that question the Dosimetry Law reached the STF on Friday and were reported by Moraes after free distribution. The minister has already adopted the first measures in the case and temporarily suspended the application of the new law to criminal executions related to those convicted of the acts of January 8th until the plenary analyzes the merits of the actions.

In the decision, Moraes stated that the existence of direct actions of unconstitutionality against the rule creates a “new and relevant procedural fact”, recommending caution to avoid legal uncertainty.

The minister also ordered the opening of the rite provided for in the ADIs Law, requesting information from the Presidency of the Republic and the National Congress within five days. Afterwards, the case will be submitted to the Attorney General’s Office (AGU) and the Attorney General’s Office (PGR).
