Moraes grants house arrest to the woman who spotted statue in the STF

Minister Alexandre de Moraes of the Federal Supreme Court (STF) granted this Friday (28) house arrest to hairdresser Débora Rodrigues dos Santos, accused of participating in the scammers of January 8, 2023 and of pending the phrase “lost, Mané” in the statue of justice.

With the decision, the accused will leave the jail and will serve house arrest in Paulínia (SP), where he resides. Deborah should wear electronic anklet, will not be able to wear social networks or have contact with other investigated. In the event of non -compliance, she should return to the prison.

Moraes’s decision was motivated by a request for freedom made this week by defending the accused, who has been arrested since March 2023.

Earlier, in an opinion sent to the Supreme, the Attorney General’s Office (PGR) spoke against release, but argued that Deborah’s pre-trial detention may be replaced by house arrest because she has two minor children, and, according to criminal law, is entitled to the benefit. The hairdresser is the mother of two boys, 10 and 12 years old.

Judgment

The trial that will decide whether Deborah will be convicted last week, but was interrupted by a request for a view of Minister Luiz Fux.

Prior to the suspension of the trial, the rapporteur of the case, Alexandre de Moraes, voted to convict Deborah to 14 years in prison in a closed regime.

To define this time of arrest, Moraes added the penalties of five crimes reported by PGR. The penalty was average of the other convictions of those accused of participating in January 8. The penalties range from 14 to 17 years.

According to the vote for the conviction, those investigated by the scammer acts committed multitudinal crimes, that is, of collective authorship. Thus, they respond together for the five crimes.

Sum of convictions

The sum to reach the 14 -year penalty was made as follows:

  • Violent abolition of the Democratic Rule of Law (4 years and 6 months);
  • Study: (5 years);
  • Armed criminal association (1 years and 6 months);
  • Qualified damage: (1 year and 6 months);
  • Deterioration of listed assets (1 year and 6 months);
  • CLOSED REGIME: Feathers over 8 years start in closed regime.
  • Indemnity of 30 million: All convicted by the January 8 will have to pay the amount jointly and severally for the data caused by the depredation.

In a statement given last year to the Supreme Court, Debora Rodrigues said she regrets having participated in the acts and having stroked the statue.
