Moraes: ‘Judges, including this Court, never judge cases in which they have a connection’
The Minister of the Federal Supreme Court (STF) Alexandre de Moraes said that no judge, including the Court, judges cases with which they have a connection. “A magistrate cannot have a connection with the case he judges. And all magistrates, including this Supreme Court, never judge any case in which they have a connection”, he stated in a plenary session on the afternoon of Wednesday, 4th, during the trial that deals with the rules for the use of social networks by judges.
Moraes classified as an “absurd lie” the statement that the Supreme Court authorized magistrates to judge cases involving their relatives. In 2023, the Court declared unconstitutional a rule that prohibited magistrates from judging cases in which the party is a client of a law firm belonging to relatives and spouses. Judges are still prohibited from ruling on the specific case in which a relative or spouse is a party or serves as an attorney.

“The magistrate, from the 1st instance to the STF, is prevented from judging any case in which he has, on any of the parties or lawyers, his relatives. But, in an absolutely unworthy manner, some of the attackers of this STF, and with regrettable support from part of the media, have been repeating this lie”, he highlighted. “Several of us contacted our press office to clarify this, and the press continues.”

Moraes also said that “there is no public career with as many restrictions as the judiciary”. “The magistrate cannot do anything else in life, only teaching. And as he can only give classes and lectures, they began to demonize lectures given by magistrates”, said Moraes.
He added: “For lack of anything to criticize, soon the bad faith will also affect those who teach at universities.”
