Spanish Justice denies new request for extradition of Oswaldo Eustáquio to Brazil

The Justice of Spain decided, on Monday (15), to deny a new request for extradition of Oswaldo Eustáquio Filho, requested by the Brazilian government.
Eustáquio is accused of involvement in an attempted coup d’état and inciting undemocratic acts through his publications on social networks.
The Spanish Court based its decision by stating that the request for extradition was motivated for political reasons and that there is no bilateral agreement between Brazil and Spain that allows extradition in cases of this nature. The decision is subject to appeal.

Oswaldo Eustáquio has been in Spain since 2023 and, on several occasions, told local courts that he has not committed any crime, claiming to be the target of political persecution.
The Brazilian government argues that he used his digital platforms to incite the closure of Congress and the Federal Supreme Court in 2021, as well as pursuing police officers investigating the attempted coup.
This is not the first time an Eustachian extradition request has been denied.
In March, the Spanish court had already rejected a similar request, claiming that the acts attributed to the blogger would be protected by the right to freedom of expression, although they represent crimes in Brazilian law, such as the violent abolition of the democratic state and the attempted coup.
In addition to the accusations already mentioned, Eustáquio is also suspected of corruption of minors.
