Zanin rejects a request for collective freedom of deputy to prisoners of January 8

Minister Cristiano Zanin of the Federal Supreme Court (STF) rejected on Friday (4) the collective habeas corpus presented by federal deputy Luciano Zucco (PL-RS) in favor of the prisoners for the scammer acts of January 8, 2023.

According to the magistrate, there is no habeas corpus originating from the STF plenary against a decision already taken by one of its classes or by the plenary itself, as established in Precedent 606 of the Court.

The parliamentarian – who is the leader of the opposition in the House – argued that the request would be a “measure of justice and equity”, citing the case of hairdresser Débora Rodrigues dos Santos, who had his arrest converted into home by Minister Alexandre de Moraes. Deborah became known for Pichar the Statue of Justice, in front of the STF headquarters, with the phrase “Lost, Mané”, in reference to Minister Luís Roberto Barroso.

Zucco claimed that since the January 2023 attacks, several parliamentarians have received complaints of basic rights from people arrested because of the so -called collective flagrant arrest, which took more than 1,400 people to the Federal District prison system.

In rejecting habeas corpus, Zanin made it clear that the negative does not analyze the merits of the request, but only the regimental impossibility of reversing previous court decisions through new habeas corpus.

The decision represents another setback for allies of former President Jair Bolsonaro (PL), who have pressured Congress for the approval of an amnesty project involved on January 8.
