Parliamentarians deny irregularities in the direction of resources. The defenses asked the Supreme Court to reject the complaint for lack of evidence.
As a rapporteur, Zanin opened the votes. He stated that there is “considerable evidence of authorship and materiality”, that is, elements that suggest the participation of deputies in deviations.
“Against the three parliamentarians there is evidence produced throughout the criminal investigation indicating that they would have acted in illicit concertation to request Mayor José Eudes Sampaio Nunes the payment of improper advantage, which characterizes, in theory, the crime of passive corruption,” says an excerpt from the vote.
The minister mentions, for example, notes and spreadsheets seized by the Federal Police at the house of former mayor of Água Doce (MA), Antonio José Silva Rocha (PSDB), about the division of the diverted money from the amendments.
“In fact, it is possible to visualize in the documents the specification of the amounts (25%), the names and party acronyms of the three parliamentarians involved in the alleged criminal concertation (Josimar Maranhãozinho, Pastor Gil and Bosco Costa),” says Zanin.
The first class also comprises ministers Alexandre de Moraes, Cármen Lúcia, Flávio Dino and Luiz Fux. The vote is open until March 11 at the Virtual Plenary of the Supreme Court.
The investigation that led to the complaint is an offshoot of an operation that started in Maranhão in December 2020. During the inquiry, the Federal Police obtained images of Josimar Maranhãozinho handling a large amount of money that, according to the corporation, would have been obtained with the deviation of amendments.
The PGR concluded that the deputies negotiated amendments with the City of São José de Ribamar, in Greater São Luís, in exchange for a “percentage” for the funds passed on. Former Mayor José Eudes Sampaio Nunes narrated charges and intimidation in exchange for the destination of the funds to the municipality.
According to the Attorney General’s Office, parliamentarians requested a 25% bribe over the amendments, or R $ 1.66 million in exchange for R $ 6.67 million for the municipality.
“The informative elements show, therefore, that the accused formed criminal organization, led by Josimar Maranhãozinho, focused on the improper marketing of parliamentary amendments,” says the complaint.
In addition to the deputies, Minister Cristiano Zanin also voted to make defendants João Batista Magalhães (former parliamentary advisor), Antonio José Silva Rocha (former mayor of Fresh Water), Abraão Nunes Martins Neto (retired military police), Adones Gomes Martins (brother of Abraham) and Thalles Andrade Costa (son of Bosco Costa).
