STF: Dino suspends rule that equates retirement of male and female police officers

Minister Flávio Dino, of the Federal Supreme Court (STF), suspended the section of the Social Security reform that sets the same criteria for the retirement of male and female police officers, that is, the age of 55.

The minister understands that there is “unfair discrimination” because, in other categories, there is a difference in retirement criteria for men and women.

Dino responded to a request for an injunction formulated by the Association of Police Delegates of Brazil (Adepol). “I understand that the incidence of the contested discipline, by hindering or even preventing the retirement of female civil and federal police officers, has the potential to cause irreparable damage or damage that is difficult to repair”, noted the magistrate in his decision, published this Thursday (17 ).

According to the minister, until Congress issues a new rule on the subject, the general rule of three years of reduction will be applied to all deadlines that refer to female civil and federal police officers.

“I would add that the National Congress, when legislating to correct the unconstitutionality regarding women, must adopt the differentiation it deems appropriate in light of legislative discretion,” stated Dino.
