Daniel Silveira is taken to the public prison in Benfica, Rio
The former federal deputy Daniel Silveira (no party-RJ) He was admitted this Tuesday morning (24) to the José Frederico Marques Public Prison (Benfica), in the north zone of the city of Rio de Janeiro.
The information was released by the State Secretariat for Penitentiary Administration (Seap).
According to Seap, Silveira will wait in the Benfica jail for the custody hearing to be held by the Rio Court. According to the Court of Justice (TJ-RJ), however, there is still no information about the hearing.
Silveira was arrested again this Tuesday morning, by the Federal Police (PF), after having his parole – which had been granted on December 20th – revoked by the Minister of the Federal Supreme Court (STF) Alexandre de Moraes.

According to Minister Alexandre de Moraes, from the STF, on the first day of probation, Silveira violated the curfew and returned home after the stipulated deadline, 10 p.m.
Silveira had been sentenced to 8 years and 9 months in prison in 2022 and, since October of this year, he had been in a semi-open regime.
According to Moraes, after being released on Saturday (21), the former deputy returned home at 2:10 am on Sunday (22), four hours later than allowed, violating the terms of his probation.
The defense argued that Silveira had a medical emergency and needed to stay in the hospital from 10:59 pm on Saturday (21) to 0:34 am the following day (22).

Moraes did not accept the defense’s allegation and considered that there was no judicial authorization for Silveira to be taken to the hospital. Furthermore, the minister said that the former deputy took more than an hour and a half to get home after the medical appointment time informed by the defense.
In a statement released this Tuesday, Silveira’s lawyers stated that there was no violation of the terms of probation, as their client had a kidney crisis and could not wait for the Judiciary to be released to seek medical care.
