Silveira’s lawyers ask Moraes for guidance on returning the former deputy’s gun

The defense of the former federal deputy Daniel Silveira asked the minister Alexandre de Moraesfrom the Federal Supreme Court (STF), clarifications on how a .380 caliber pistol registered in his name should be returned.

The lawyers claim that, with Silveira arrested, none of the legal representatives have authorization to transport the weapon.

The order, issued by Moraes on Wednesday (15), provided for delivery to the Court within 48 hours.

In the request, the lawyers highlighted the need for details about the location and security measures to ensure compliance with the court order.

The request was made “within the deadline” and demonstrates, according to the note, the “collaborative spirit” of the defense. The pistol in question is a Taurus .380, registered with the Military Police of the State of Rio de Janeiro.

Daniel Silveira was sentenced in April 2022 to eight years and nine months in prison for inciting acts against the Democratic Rule of Law. Since then, it has faced a series of changes to its penal regime.

In October 2024, he entered the semi-open regime, obtaining parole in December. However, Alexandre de Moraes revoked the benefit days later, due to non-compliance with precautionary measures.

Among the violations highlighted, Silveira allegedly returned home at 2:10 am on December 22, violating the nighttime curfew imposed as a condition of freedom. The defense argued that he suffered a kidney crisis and needed urgent hospital care, but Moraes rejected the justification.

The former deputy’s defense also tries to make possible the application of a Christmas pardon signed by the president Luiz Inácio Lula da Silva (PT) at the end of 2024. In the last ten days, 11 pardon requests have already been filed with the STF, seeking alternatives to reduce the sentence.

The Disarmament Statute (Law No. 10,826/2003) establishes that the registration of firearms requires proof of suitability and presentation of negative criminal record certificates. Silveira, however, has already been convicted of crimes related to the threat to the Democratic State and coercion during the process.
