Court ruling bars TikTok in the US

The American Supreme Court upheld a decision that could suspend the app. The text provides that, to operate in the country, TikTok must be sold to an investor from a country that is not considered an “adversary”. ByteDance, the Chinese parent company of the short video app, refuses to sell its US operation to an investor from a “friendly” country.

Government American justifies measure as protection against potential risks to national security. The law in question was approved in 2024 by Congress, with support from Democrats and Republicans, and requires TikTok to disassociate itself from ByteDance to continue operating in the US.

Platform may go offline this weekend. Last week, TikTok’s defense maintained that the application would be “deleted” on Sunday (19) if it was not authorized to operate in the country, indicating that the sale determined by law is not in the company’s plans. According to ByteDance, banning the app would violate the First Amendment of the US Constitution, which protects freedom of expression.

About 170 million Americans use the app. If TikTok is in fact banned, they will no longer receive updates and will no longer be able to download the app.

The American Supreme Court does not clearly define the future of TikTok in the USA in its decision. In principle, it would be up to the outgoing American president, Joe Biden, to ensure the suspension of TikTok on Sunday, but he decided to leave this in the hands of the president-elect, who will be inaugurated this Monday.
