STJ keeps INSS expert point cutting

The President of the Superior Court of Justice (STJ), Minister Herman Benjamin, denied request of the National Association of Federal Medical Experts (ANMP) to suspend the point cut of part of the medical experts of the National Institute of Social Security (INSS) that are in strike.

About 10% of professionals have been on a partial strike since August 2024. Federal medical experts charge from the federal government measures for career restructuring and server performance evaluation.

In the decision issued on Tuesday (28), the minister also maintained the validity of the circular of the agency that closed the agenda of the strikers, allowing the insured’s care to be transferred to professionals who did not join the strike movement.

For the president of the STJ, the right to strike doctors does not prevent point cutting. In addition, Herman Benjamin said that the closure of the doctors’ attendance agenda does not configure lockdown (Compulsory restrictive manner that prevents circulation in public places and only releases activities considered essential), measure to prevent the work of the servers and frustrate the effects of the strike.

“The circular letter (of the INSS) does not configure lockout (temporary stoppage of the activities of a company, carried out by the employer) because it does not determine the total and absolute closure of medical care in social security agencies, but only establishes a management measure regarding its realization, according to which only professionals who will remain In the performance of their duties, they must make the appointments, ”said the minister.

On Monday (27), the INSS reported that the expertise marked with doctors who are on strike came to be automatically resigned by the Social Security Technology and Information Company (Dataprev) to another expert that is normally attending.

According to the agency, policyholders who need to go through expertise will be notified of the day and time of the new appointment through Central 135 or by the my INSS (Automatic Messages) application.
