Congress and Executive must reach an agreement to release amendments

The Federal Supreme Court (STF) reported this Wednesday (23) that the federal government and the National Congress are in the process of concluding an agreement to regularize the release of parliamentary amendments that were suspended by the Court.

In a joint statement to the press, representatives of the Three Powers reported that the final text of the agreement should be finalized by tomorrow and be voted on next week by the Chamber of Deputies and the Senate.

The final phase of the agreement was decided after a meeting between the presidents of the Supreme Court, Luís Roberto Barroso, of the Chamber, Arthur Lira (PP-AL), and of the Senate, Rodrigo Pacheco (PSD-MG). The Union’s attorney general, Jorge Messias, and STF minister Flávio Dino, rapporteur of the case, also participated in the meeting.

After closing the agreement, Dino will evaluate the clauses and submit them to the STF plenary for voting. There is still no deadline for deliberation.

In December 2022, the STF understood that the amendments called RP 8 and RP 9 are unconstitutional. After the decision, the National Congress approved a resolution that changed the rules for distributing resources through rapporteur amendments to comply with the Court’s determination.

However, Psol, the party that filed the lawsuit against the amendments, pointed out that the decision continues to be in non-compliance.

After the retirement of Minister Rosa Weber, the original rapporteur of the case, Flávio Dino took over the management of the case.

In August of this year, Dino ordered the suspension of the amendments and decided that the transfers must follow traceability criteria. The minister also ordered the Comptroller General of the Union to audit the transfers made by parliamentarians through amendments to the secret budget.
