Fachin says that Moraes signals possible closure of the fake news investigation

The president of the Federal Supreme Court, Edson Fachin, stated, in a meeting with journalists this Tuesday (31), that there are ongoing discussions about the future of the fake news investigation and indicated that the case’s rapporteur, Alexandre de Moraes, demonstrated openness to evaluate the closure of the investigation.

The investigation was launched in 2019, still under Dias Toffoli as president of the Court, in a context of escalating attacks against the Supreme Court. Since then, the procedure has established itself as one of the main instruments for investigating disinformation and threats to ministers.

Fachin said that the length of the investigation became a cause for concern within the court. In a conversation with journalists, he stated that the topic has been debated among ministers and that the current situation requires an assessment of the continuity of the investigation.

“The question is whether the time has come to think about ending this type of activity,” he declared.

The minister highlighted that he does not intend to move in this direction without the agreement of Moraes, responsible for conducting the work. According to him, the dialogue with the rapporteur has been positive, but any decisions still depend on the next developments.

When commenting on his position, Fachin recalled that he voted for the constitutionality of the inquiry in 2020, highlighting its role in protecting democratic institutions. At the same time, he indicated that the extent of the investigation needs to be reassessed. “The difference between medicine and poison is the dose,” he said.
