Lava Jato: STF rejects appeal and maintains Collor's sentence of 8 years and 10 months in prison

The Federal Supreme Court (STF) formed a majority, this Thursday (14), to reject appeals presented by the former president’s defense Fernando Collor de Mello and maintain his sentence of 8 years and 10 months in prison, as part of a process related to Operation Lava Jato.

By 6 votes to 4, the Court’s ministers rejected the arguments of Collor’s lawyers, who challenged a decision taken in 2023, when the former president was convicted of corruption and money laundering.

After this Thursday’s decision, Collor can still present new appeals against confirmation of the conviction. The execution of the sentence, as a rule, is only determined by the STF after the judgment of the so-called second embargoes.

On the other hand, the Attorney General’s Office (PGR) may request the immediate execution of the former president’s sentence. In this case, it would be up to the rapporteur of the Court case, Minister Alexandre de Moraes, to evaluate this request.

The rapporteur’s vote, which called for Collor’s sentence to be maintained, was followed by five other ministers: Luís Roberto Barroso, Luiz Fux, Cármen Lúcia, Flávio Dino and Edson Fachin.

The divergence was opened by Minister Dias Toffoli, who defended a lesser punishment of 4 years, which would allow Collor to free himself from the closed regime. The magistrate was followed by ministers Gilmar Mendes, Nunes Marques and André Mendonça. Minister Cristiano Zanin declared himself unable to participate in the trial.

Collor was convicted by the Supreme Court in May last year. In September, after the publication of the trial ruling, the former president’s defense filed embargoes.

Collor was convicted of passive corruption and money laundering for a scheme involving BR Distribuidora investigated by Lava Jato. Two other defendants were also sentenced: Pedro Paulo Bergamaschi de Leoni Ramos, the operator of the scheme (to 4 years and 1 month in prison), and Luís Amorim, executive director of the Arnon de Mello Organization (3 years and 10 days).
