The defense of former President Jair Bolsonaro (PL) handed over this Thursday to the Federal Supreme Court (STF) his response to accusations of attempted coup in 2022. In the document, the lawyers requested that the trial, which may accept the complaint and make Bolsonaro defendant, be carried out in the court plenary, not in the first class, as with other criminal investigations.

  • After the defenses of the accused of trying a blow to keep Bolsonaro in power, Moraes decides whether the case will be tried by the first class or the plenary. The initial judgment will serve to accept or reject the complaint of the Attorney General’s Office (PGR).
  • If the prosecution is accepted, Bolsonaro will become a defendant and will respond to a criminal action. If the complaint is rejected, the process will be filed.
  • If the criminal action is opened, the evidence production phase will begin, including expertise of documents and testimonials from both defense and prosecution. After the end of this phase, Moraes, as a rapporteur, will elaborate his vote, with no specific deadline for this analysis. The trial will only occur after the report.
  • The expectation in the Supreme Court is that the trial will be completed by the end of 2024, in order to prevent the case from drafting to 2026, an election year.

The defense also criticized the inquiry rapporteur, Alexandre de Moraes, and claimed that he had not had full access to the material of investigations conducted by the Federal Police.

According to the lawyers, Moraes exceeded his role as a magistrate by sorting off office, stating that the accusatory model imposes limits on the judge’s performance, which cannot replace the prosecutor. Although Bolsonaro tried to earn more time to defend himself, Moraes denied the requests and maintained the 15 -day deadline for the defense.
