Rumble case: US court authorizes Moraes to be notified by email

The federal court in Florida, in the United States, authorized this Friday the technology companies Rumble and Trump Media —owner of the social network Truth Social— to quote by email Minister Alexandre de Moraes, of the Federal Supreme Court (STF), in a legal action filed in the American country against the minister.

The process moved again this Friday. The court determined that Moraes can be cited via institutional emails linked to the Supreme Court within 30 days by the companies, which must present proof to the court that it was carried out. With the summons effective, the minister will have to comment or ask for more time. The minister was contacted via the STF press office, but there was no response.

The companies’ defense had asked the court that this notification could occur by email in an order in February this year. At that time, the lawyers’ argument was that a formal way to contact the magistrate had been “blocked” in Brazil. Trump Media is led by American President Donald Trump.

With this week’s decision, the action, which had been held up since last year due to the lack of a summons to the minister, should move forward. The companies sued the Federal Court of Florida in 2025 with the aim of blocking orders from Moraes to remove profiles of Bolsonaristas on the respective platforms.

The companies accuse Moraes of violating the First Amendment of the American Constitution, which deals with freedom of expression, by ordering Rumble to remove accounts of Brazilian right-wing influencers. The allegation is that the determination would violate the country’s legislation by censoring political speeches circulating in the USA.

As the case unfolded, other parties joined the accusation and provoked the court with requests for an investigation against the judge based on the Magnitsky Act, applied at the end of July by the Trump administration and suspended in December.

Lawyer for Trump Media and the social network Rumble, Martin de Luca celebrated the progress of the action in a post on social media. He stated that, with the decision, Moraes will have to answer to an American court or “could suffer a decision in absentia”.

Eduardo Bolsonaro (PL-SP), one of the former president’s sons, stated on social media that, given the progress of the action, Moraes’ “future is uncertain”. “But depending on how everything goes, he may no longer be able to leave Brazil without suffering consequences from this process where he lands, as it is unlikely that any country demanded by the USA will choose Brazil’s side in this dispute,” he wrote.
